Terms of service

1. Scope and definitions

These Terms of Service (the "Terms") govern your use of the ITALSPEC marketplace (the "Platform"), operated by Tomás Teixeira (Social Media Tomás Teixeira), Nunnenbeckstr. 51, 90489 Nürnberg, Germany ("we", "us", or "ITALSPEC"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. The service we provide

ITALSPEC is a curated online marketplace for Italian sports cars, classics, youngtimers and collectible vehicles. We provide the technical platform that lets sellers publish listings and lets buyers discover them and contact sellers directly. We are an intermediary only: we are not a party to any purchase, sale, or contract between users, we do not take possession of any vehicle, and we do not act as broker, agent, or escrow. All transactions are concluded directly between buyer and seller.

3. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Platform. To publish a listing or use certain features you must create an account with accurate, current and complete information. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.

4. Listings and content

All listings are subject to review before publication. Listings must describe eligible Italian vehicles only and must be accurate, lawful, and complete. You may only list a vehicle you are entitled to sell. We may decline, edit, request changes to, or remove any listing that does not meet our standards, and we may suspend accounts that breach these Terms. Editing a published listing returns it to review before it becomes visible again.

5. Fees and payment

Publishing a private-seller listing requires payment of the listing fee displayed at checkout (currently €150 for a two-month listing period, renewable for €100 per additional two months). Dealers list according to the plan they have arranged with us. All prices are shown before you confirm payment. Payments are processed by our payment provider (Stripe). Fees are non-refundable once a listing has been published, except where required by mandatory law. We may change our fees with reasonable advance notice.

6. Consumer right of withdrawal

If you are a consumer in the EU, you may have a statutory right to withdraw from a contract within 14 days. Because our service (the publication of your listing) begins immediately at your request, you acknowledge that your right of withdrawal expires once the service has been fully performed, to the extent permitted by law. Nothing in these Terms limits mandatory consumer protection rights that apply in your country of residence.

7. Prohibited conduct

You agree not to:

• post false, misleading, fraudulent or unlawful content;
• list vehicles you are not entitled to sell, or that infringe third party rights;
• use the Platform to send spam, harass other users, or scrape data;
• attempt to circumvent security, payments, or the review process; or
• upload malware or interfere with the Platform's operation.

8. Seller responsibilities and warranties

Sellers are solely responsible for the accuracy and legality of their listings, for the vehicle's description and condition, and for complying with all laws applicable to the sale (including consumer, tax and export rules). You warrant that you have the right to sell the vehicle and to publish all content you upload.

9. Buyer responsibilities

Buyers are responsible for conducting their own due diligence, including inspecting the vehicle, verifying documentation and history, and satisfying themselves as to condition and value before entering any transaction. ITALSPEC does not verify the accuracy of listings or the identity of users beyond its curation process.

10. Intellectual property and licence

The Platform, its design, and its content (excluding user content) are owned by ITALSPEC and protected by intellectual property law. By uploading content (photos, videos, text), you grant us a non-exclusive, worldwide, royalty-free licence to host, display, resize and promote that content for the purpose of operating and marketing the Platform. You retain ownership of your content.

11. Disclaimer and limitation of liability

The Platform is provided "as is" and "as available". We make no guarantee regarding the accuracy of listings, the condition or provenance of any vehicle, or the conduct of any user, and we are not liable for any transaction concluded between users. To the extent permitted by law, ITALSPEC's liability is limited to damages caused by intent or gross negligence, and to the breach of essential contractual obligations; in the latter case liability is limited to foreseeable, typical damages. Liability for injury to life, body or health, and under mandatory product liability law, remains unaffected.

12. Indemnification

You agree to indemnify and hold ITALSPEC harmless from claims arising out of your listings, your use of the Platform, or your breach of these Terms, to the extent permitted by law.

13. Term and termination

You may stop using the Platform and delete your account at any time from your account settings; this removes your account and associated listings. We may suspend or terminate accounts that breach these Terms or the law. Provisions that by their nature should survive termination (e.g. liability, intellectual property) will do so.

14. Changes to these Terms

We may amend these Terms where necessary. We will publish the updated version on this page and, for material changes, take reasonable steps to notify registered users. Continued use after changes take effect constitutes acceptance.

15. Governing law and jurisdiction

These Terms are governed by the laws of the country in which the operator is established (Germany), excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer, you also enjoy the mandatory protections of the law of your country of residence, and mandatory statutory places of jurisdiction remain unaffected. For all other users, the courts at the operator's registered seat have jurisdiction.

16. Severability and contact

If any provision of these Terms is found invalid, the remaining provisions remain in effect. Questions about these Terms can be sent to contact@italspec.com.
